Letter #99-03 (Super Agents' Contingency Program)

We are pleased to announce the addition of a "Super Agents' Contingency" to our Fulmont Mutual Contingent Commission plan effective for the year 1999.

An agency with $200,000 or more earned premium will be considered a "Super Agent". If the agent qualifies for a Contingent Commission, the commission will be calculated using a larger percentage. A comparison of the percentage rate is as follows:

SUPER AGENT REGULAR AGENT
0-15% Loss Ratio = 8% x Profit 0-15% Loss Ratio = 4% x Profit
15.01-30% Loss Ratio = 6% x Profit 15.01-30% Loss Ratio = 3% x Profit
30.1-50% Loss Ratio = 4% x Profit 30.1-50% Loss Ratio = 2% x Profit

Agents grand fathered under the previous contract as of April 13, 1982 will be paid for Earned Premiums of $20,000 to $34,999. These agents are not eligible for the Bonus Program. The following Contingent Commission Rate will be paid: 50% & Under Loss Ratio - 1/2% x Profit

Calculation of Contingent Commission Program (January 1, 1999):

  1. Premium Base: The premium base for the Contingent Commission Program will be Earned Premium.
  2. Losses & Loss Adjusting Expenses: Losses will be on an Incurred Basis. Loss Adjusting Expenses will equal Allocated and Unallocated Expense Ratio.
  3. Stop Losses: A "Stop Loss" will be included in the program at $100,000. Amounts of individual losses over $100,000 will not be included in the Contingent Commission Calculation.
  4. Number of Years in Contingent Calculation: One year, being January 1 through December 31, will be used in the calculation.
  5. Eligibility Computation: The computation for Contingent Commission will be Earned Premiums Less Loss And Adjusting Expenses Equals Profit, as described in Item #2 above. If  loss ratio is 50% or less, you would be eligible for the Contingent Commission Program.
  6. Contingent Commission Rates: See Chart Above
  7. Bonus Program: If the Earned Premium for the current year is at least 10% more than the previous year, 1% additional commission times Earned Premium will be paid. This does not include some rollover business plans. The bonus program will apply only to agents eligible and qualifying for the Contingent Commission Program.
  8. Contingent Commission Reduction: If the Earned Premium for the current yaer is more than 5% LESS THAN the previous year, 1% commission Times Earned Premium will be subtracted from the Contingent Commission check. This applies only to agents qualifying fir the Contingent Program.

Letter #99-02 (Entrepreneurship Series)

Investigate your possibilities for new business with our new Entrepreneurship Series - Home Based Business Policy. This new program is designed to provide coverage for the policyholder operating a business from their private residence or related private structure. It provides a Businessowners Policy for a less expensive minimum premium than a regular Businessowners Policy. The policyholder can also purchase additional coverage forms which enhance our current BOP coverages. If your customer has a beauty salon or barber shop in their residence they can purchase additional coverage which will provide the state-required Beauty Shop/Barber Shop Professional Liability coverage and a variety of enhanced BOP coverages.

Please review the information and contact your underwriter if you should have any questions. We are confident this new program will provide your customers with the proper coverage for their Home-based Business.

Letter #98-02 (Certificates of Insurance)

Recently the State of New York Insurance Department issued an important letter to New York State Licensed Producers regarding the use of Certificates of Insurance as evidence of insurance coverage.

The letter advises producers "that they may not add terms or clauses to a Certificate of Insurance which alter, expand or otherwise modify the terms of the actual policy unless authorized by the insurer which has filed an appropriate endorsement with the Superintendent of Insurance and obtained prior approval, if required." The letter further states, "The Department may seek disciplinary measures against producers who continue this practice without authorization from the insurer."

RE: The Use of Certificates of Insurance as Evidence of Insurance Coverages
This supplements Circular Letter No. 8, June 7, 1995

It has come to our attention that city, state and municipal agencies and other public authorities and corporations require, as a condition of doing business, that insured parties supply evidence of insurance on preprinted forms supplied by the agency. These forms may appear to alter, expand or modify the terms of the subject insurance policy. In other cases, the Government agency may require the insured to add terms to the standard ACORD certificate of insurance form which do not appear in the insurance policy.

In addition, it has come to our attention that some licensed producers may complete these certificate of insurance forms on behalf of their clients and add terms or clauses that the public entity requires but which are not contained in the insurance policy.

A certificate of insurance which lists the pertinent coverage terms as they appear in the actual policy is not considered a policy form that requires the Superintendent's prior approval. However, any document that amends, expands or otherwise alters the terms of the applicable insurance policy constitutes a policy form which must be filed with the Superintendent of Insurance in accordance with Section 2307(b) of the Insurance Law.

Licensed producers are advised that they may not add terms or clauses to a certificate of insurance which alter, expand or otherwise modify the terms of the actual policy unless authorized by the insurer which has filed an appropriate endorsement with the Superintendent of Insurance and obtained prior approval, if required. The Department may seek disciplinary measures against producers who continue this practice without authorization from the insurer.

City, state, and municipal agencies, and other public authorities and corporations are advised that a certificate of insurance, even one completed by a licensed producer, is not the best evidence of the terms of an insurance policy and may not accurately reflect the actual terms of the policy.

RE: The Use of Certificates of Insurance

It has come to our attention-that some cities, counties, and other organizations require as a condition of doing business that insured parties produce certificates of insurance on forms that appear to alter the terms of the actual policy. Some of these certificates incorporate 'hold harmless' agreements or other clauses that alter the language of the policy, or include statements that the wording of the certificate will control in the event of any inconsistency or conflict between the certificate and the policy.

Insurers are advised that certificates of insurance should be used only to provide evidence of insurance in lieu of an actual copy of the applicable insurance policy. Certificates should not be used to amend, expand, or otherwise alter the terms of the actual policy.

A certificate of insurance that lists the pertinent coverage terms as they appear in the actual policy is not considered a policy form that requires the Superintendent's prior approval. However, one that amends, expands or otherwise alters the terms of the applicable insurance policy constitutes a policy form, which must be filed with the Superintendent of Insurance in accordance with Section 2307(b) of the Insurance Law.Questions or comments on this subject may be directed to:

Letter #98-03 (Y2K)

The year 2000, also known as "Y2K" or the "Millennium Bug" crisis, requires major changes to technology systems and data bases.

We started working on the "2000" project three years ago, completing it early this year. Please rest assured that Fulmont Mutual Insurance Company is "Y2K" compliant. The entire cost of this project was borne by the Company and spread out over a three year period. The NYS Insurance Department is aggressively pursuing action through targeted investigations to verify that insurance companies as well as licensed producers are or will be "2000" compliant.

If you have not already done so, we strongly urge you to address this problem to ensure that your agency, other insurance carriers and associates are all 'Y2K" compliant.

Letter #98-04 (Inland Marine Livestock Forms)

Please be advised that effective 09/01/98 for all new policies and effective 11/01/98 for all renewals, we will now be using the following forms:

MR-31, edition 05/89, Specific Livestock Form
MR-32, edition 05/89, Blanket Livestock Form
MR-33, edition 05/89, Pro Rata Livestock Form

This is due to a 'housekeeping' change in the forms - deleting reference to 'Perils' and replacing it with 'Causes of Loss'. If you would like a copy of the new forms, please contact your Farm underwriter.

Letter #98-05 (Additional Residential Premises - Occupied by Insured)

Please be advised that effective 09/01/98 for all new policies and effective 11/01/98 for all renewals, we will now be using form SF-10, 01/88, Supplemental Declarations to list coverage for Additional Residential Premises - occupied by the insured.

This will replace the previously used form ML-379-Co-op and ML-70. The premium charges will remain the same. All other Additional Residential Premises - Rented to Others will remain on form ML-70.

As a follow up to our letter number 98-03 dated June 18, 1998, we are conducting a survey regarding "Y2K" or "Year 2000" Compliance. We would appreciate if you could take the time to complete the following:

Letter #98-07 (Introduction of Y2K forms, with a calendar date exclusion form)

Effective immediately, please note that we will be attaching the appropriate 'Calendar Date Exclusion'  form to all new and renewal policies.

The forms were filed as a clarification of the Y2K issue and to restate that improperly programmed computers which may crash on 9/9/99 or 1/1/2000, or other dates before or after 2000, do not yield covered losses for that damage or ensuing damages. URB considers these forms as a 'restatement of intent,' such losses were never covered and no premium was ever charged for that exposure.
